Agreeing to these Terms
These Terms of Service ("Terms") are an agreement between you and [Company legal name] ("Nibl", "we", "us") about your use of the Nibl app and the niblapp.com website (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Nibl.
Who can use Nibl
- You must be at least 13 years old, and old enough to agree to these Terms where you live. If you're under the age of majority where you live, you confirm a parent or guardian has agreed to these Terms for you.
- You can't use Nibl if we've previously banned you, or if the law doesn't allow you to.
- One person per account. Accounts for businesses or brands may need our permission.
Your account
- Keep your sign-in details secure and don't share your account. You're responsible for what happens on it.
- Give accurate information, and don't pick a username that impersonates someone or infringes someone's rights. We may reclaim or change usernames that do.
- Tell us at support@niblapp.com if you think someone else is using your account.
- You can delete your account at any time in the app (Profile → Settings → Delete account). See Delete your account for what happens.
Your content
"Your content" means what you post on Nibl: dish photos, titles and notes, recipes, comments, your profile, your ratings and rankings, and anything else you submit.
- You own your content. These Terms don't take that away.
- You give us a licence to run Nibl with it. When you post content, you grant Nibl a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, copy, display, adapt (for example, resize photos or make thumbnails), and distribute it, only for operating, providing, promoting and improving the Service. This licence follows your privacy settings: if your account is private, we show your dishes and recipes only to the followers you approve. The licence ends when you delete the content or your account, except: (a) for copies in backups for a limited time; (b) where other people have already re-shared it outside Nibl; and (c) for recipes other people have cooked, as described next.
- Recipes other people have cooked. When someone posts their own dish of your recipe, their dish is linked to it. If you delete your account, each person who posted a dish of one of your recipes keeps their own copy of it (title, ingredients, steps, tags and times, without your photos), so their dishes stay intact. You agree to this when you post a recipe.
- Make it yours. Other people can save your recipes, post their own dishes of them, and make their own version of them in Nibl (which links back to yours).
- You're responsible for your content. Only post content you have the right to post. You confirm your content doesn't infringe anyone's rights and follows these Terms.
- Feedback. If you send us ideas or suggestions, we may use them without owing you anything.
Community rules
Nibl is for sharing home cooking. Our Community Guidelines explain these rules in plain language; this section is the binding version. Don't use Nibl to post, or help anyone else post, content that:
- is sexually explicit, or sexualizes minors in any way. Child sexual abuse and exploitation is never allowed, and we report it to the authorities (see our Child Safety Standards);
- harasses, bullies, threatens, intimidates or targets anyone, including telling someone to harm themselves;
- is hateful toward people because of race, ethnicity, national origin, religion, caste, sex, gender, gender identity, sexual orientation, disability, age or serious illness, including slurs;
- shows or encourages violence, self-harm, animal cruelty, or dangerous activities;
- promotes illegal goods or activities, including illegal drugs;
- is spam, a scam, an advertisement we haven't agreed to, or misleading;
- impersonates another person or organization, or shares someone's private information without their consent;
- infringes someone's copyright, trademark, privacy or other rights;
- gives food or health advice that could put people in danger.
And don't misuse the Service. In particular, don't:
- access accounts or data that aren't yours, or try to get around privacy settings, blocks or rate limits;
- scrape, crawl or bulk-download Nibl, or use bots or automated accounts;
- interfere with, overload, probe or reverse-engineer the Service, except where the law allows it;
- create accounts to evade a suspension or ban, or to manipulate likes, follows, rankings or scores;
- use Nibl in a way that breaks the law.
Dish photos should be of food you made. We may remove photos that aren't, and photos that our automated safety check flags are never published.
Zero tolerance, reporting and blocking
Nibl has zero tolerance for objectionable content and abusive users. If you post content that breaks the community rules above, or abuse other people, we will remove the content and may suspend or permanently ban your account, without warning.
- Report: you can report a dish, a recipe, a comment or a person from the ⋯ menu on it (for a comment, press and hold it). We review reports and act on them within 24 hours, by removing the content and suspending or banning accounts as needed.
- Block: you can block anyone from the ⋯ menu on their profile, dish or comment. Once you block someone, neither of you can see the other's dishes, recipes or comments, and any follows between you are removed. You can unblock people in Settings → Blocked accounts.
- Remove comments: you can delete any comment on your own dishes.
- Automated checks: photos are checked automatically before anyone else can see them, and some offensive language is blocked automatically. These checks aren't perfect, and they don't replace your reports.
- If you see something that puts someone in immediate danger, contact your local emergency services first.
You can also email support@niblapp.com to report content or behaviour. We don't have to monitor everything posted on Nibl, but we may review, remove or restrict any content at any time for any reason, including to comply with the law.
Recipes, imports and copyright
- Credit your sources. If a recipe isn't your own, say where it came from. Don't copy someone else's recipe write-up, photos or book word for word.
- Importing from a link. When you import a recipe from a web page, Nibl pulls in the recipe's facts (title, ingredients, times, servings, and a photo link) and keeps a link and credit to the source. It doesn't copy the page's written method; you write the steps in your own words. Keep the attribution, and don't import content you don't have the right to use.
- Imports are automated and can be wrong or incomplete. Check the ingredients and quantities before you cook.
- Lists of ingredients and basic facts usually can't be owned by anyone, but photos, stories and written instructions can. When in doubt, write it yourself and link to the original.
Copyright complaints
If you believe content on Nibl infringes your copyright, email support@niblapp.com with: your contact details; a description of the work you own; where the content is on Nibl (the username and the dish or recipe); a statement that you have a good-faith belief the use isn't authorized by you, your agent or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for them; and your physical or electronic signature. Our designated copyright agent is [Designated DMCA agent name and address]. We remove infringing content and disable the accounts of repeat infringers.
Food safety and allergens
Recipes on Nibl are written by people like you, not by us, and we don't test or check them. Cooking involves heat, sharp tools and ingredients that can make people ill. You cook at your own risk.
- Allergens: always read every ingredient yourself. Recipes may be missing ingredients, list them wrongly, or contain allergens that aren't called out. When Nibl uses your allergies to hide recipes from suggestions, that's a convenience based on simple ingredient matching; it is not a safety guarantee and will miss things.
- Food safety: follow safe handling, storage and cooking temperatures, whatever a recipe says.
- Nutrition: calories, macros, times, servings, difficulty and dietary tags are estimates entered by people or extracted automatically. They aren't medical or nutritional advice. Talk to a qualified professional about any medical condition or diet.
- Scores reflect people's personal opinions of their own cooking, not a review of a recipe's quality or safety.
Our service
- Nibl is free to use. If we ever introduce paid features, we'll show you the price and terms before you buy.
- We're constantly changing Nibl. We may add, change or remove features, or stop offering the Service, at any time. If we shut Nibl down, we'll try to give you notice so you can save what matters to you.
- Nibl's name, logo, mascot, app design and software belong to us and are protected by law. These Terms give you a personal, non-transferable licence to use the app as intended; they don't give you any rights to our brand.
- Links to other websites (like the source of an imported recipe) aren't under our control, and we're not responsible for them.
Suspension and termination
- You can stop using Nibl and delete your account at any time.
- We may suspend or terminate your account, or remove your content, if you break these Terms, if we're required to by law, or if your account creates risk or legal exposure for us or others. While an account is suspended, it can't post, comment, like or follow, and its content is hidden from others.
- If you think we got it wrong, email support@niblapp.com and we'll take another look.
- When your account ends, the licence you gave us ends as described in "Your content", and the sections of these Terms that by their nature should survive (including content licences already granted to other people, food safety, disclaimers, limitation of liability, indemnity and governing law) still apply.
Disclaimers
Nibl is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise the Service will be uninterrupted, secure or error-free, that content on it is accurate, safe or reliable, or that recipes will turn out well. We aren't responsible for content posted by other people or for their conduct, on or off Nibl.
Limitation of liability
To the fullest extent the law allows, Nibl and its affiliates, officers, employees and agents won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or other intangible losses, arising from your use of (or inability to use) the Service, any content on it, including recipes and the results of cooking them, or the conduct of anyone else on it. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or US$100.
Some places don't allow some of these limits, so they may not apply to you. Nothing in these Terms limits liability that can't be limited by law, or your rights as a consumer under the laws of where you live.
Indemnity
If you break these Terms or the law, or your content infringes someone's rights, and that leads to a claim against us, you agree to cover the reasonable costs and losses that result, including legal fees, to the extent the law allows.
Governing law and disputes
These Terms are governed by the laws of the State of [State], USA, without regard to its conflict-of-law rules. Any dispute that can't be resolved informally will be heard in the state or federal courts located in [County], [State], and you and we consent to their jurisdiction, unless the law where you live gives you the right to bring claims in your local courts. Before filing a claim, please email us at support@niblapp.com so we can try to sort it out.
App stores
If you downloaded Nibl from Apple's App Store or Google Play, these Terms are between you and us, not Apple or Google, and we (not they) are responsible for the app and its content. Apple and Google have no obligation to provide support or maintenance for the app; for support, contact us (see Support). If you got the app from Apple's App Store, your licence to use it is limited to Apple-branded devices you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions. If the app fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); otherwise Apple has no warranty obligation. Apple isn't responsible for handling claims about the app, including product-liability claims, consumer-protection claims, or claims that the app infringes someone's intellectual property. You confirm you're not in a country subject to a US government embargo and aren't on a US government list of restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and can enforce them against you. Your use of the app must also follow the store's own terms.
General
- Changes. We may update these Terms. We'll change the "Last updated" date, and if a change is significant we'll tell you in the app before it takes effect. If you keep using Nibl after that, you accept the new Terms.
- Whole agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
- Severability. If part of these Terms can't be enforced, the rest still applies.
- No waiver. If we don't enforce something right away, we haven't given up the right to.
- Assignment. You can't transfer these Terms to anyone else. We can, for example as part of a merger or sale.
